Privacy Policy

Last updated: [TODO — date]

Draft — not legal advice. This is a structural template covering the topics a financial services privacy policy has to address. A lending business handles nonpublic personal financial information, which brings the Gramm-Leach-Bliley Act, state privacy laws, and possibly CCPA into play. Have an attorney review and complete this before you take a single application.

Information we collect

When you apply for financing through Sparks Family Finance, we collect information you provide directly: your name, contact details, business name and structure, industry, revenue, time in business, and the purpose of the requested financing. To evaluate a request we also collect business bank statements, tax returns, and financial statements, and we obtain business and personal credit reports with your authorization.

We collect limited technical information automatically — pages visited, referring source, approximate location from IP address, and device type. [TODO: name your analytics provider here, and disclose any advertising pixels you add.]

How we use it

  • To evaluate your financing request and identify suitable lenders
  • To submit your application to lenders you have authorized us to approach
  • To communicate with you about your application and your account
  • To meet legal, regulatory, and recordkeeping obligations

Who we share it with

We share your information with lenders and funding partners for the purpose of evaluating and placing your financing request, and with service providers who support our operations (document storage, email delivery, credit reporting agencies). We do not sell your information, and we do not share it with other brokers or lead buyers.

[TODO: list your actual service providers and lending partners by category, and state whether any transfer constitutes a “sale” or “sharing” under applicable state law.]

How we protect it

[TODO: describe your actual safeguards — encryption in transit and at rest, access controls, retention schedule, and your incident response process. Do not describe protections you have not implemented.]

Your choices

You may request access to the information we hold about you, ask us to correct it, or ask us to delete it where we are not required to retain it. To make a request, contact us at klark@sparksfamilyfinance.com.

You can opt out of marketing messages at any time by replying STOP to a text, using the unsubscribe link in an email, or contacting us directly. We will still send messages necessary to service an active application.
